June 2014 Visa Bulletin Now Available – EB3 China Retrogresses 6 Years
Department of State released the June 2014 visa bulletin.
Following summary highlights relevant changes for our clients:
• For EB1, all priority dates remain current.
• For EB2 (including National Interest Waiver), all priority dates except China-mainland born and India remain current. Priority date for China-mainland born moved about 1 month to 5/22/2009. The priority date for India remains the same at 11/15/2004.
• EB3 category’s priority dates went through significant changes, particularly for China-mainland born. EB3 China retrogressed 6 years from 10/01/2012 to 10/01/2006. EB3 India moved up 2 weeks from 10/01/2003 to 10/15/2003. EB3 Philippines moved up 3 months from 11/01/2007 to 1/01/2008. All other EB3 priority date retrogressed more than 1 year from 10/01/2012 to 04/01/2011.
• For EB5, priority dates remain current.
• In the family sponsored F2A category, the priority date for China-mainland born retrogressed more than 1 year from 9/8/2013 to 5/01/2012.

For China-mainland born EB3 applicants who filed EB3 petition based on previously approved EB2, the chances of obtaining green seems based on EB3 seem very slim with this month’s retrogression. However, you can still file I-485 during May if priority date is before the May Visa Bulletin date if you want to stay in U.S. under period of authorized stay. Also, if your I-140 and I-485 has been pending for more than 6 months, you may want to consider requesting premium processing service.
