March 2014 Visa Bulletin Now Available

Department of State released the March 2014 Visa Bulletin.

The following summary highlights the relevant changes for our clients:

• For EB1, all priority dates remain current.
• For EB2 (including National Interest Waiver), all priority dates except China-mainland born and India remain current. Priority date for China-mainland born moved up a little over 1 month to 2/15/2009. However, priority date for India remains the same at 11/15/2004.
• For EB3, priority date for China-mainland born moved up 3 months from 6/1/2012 to 9/1/2012. This movement is same for all countries except India and the Philippines. India’s EB3 priority date moved up 15 days from 9/1/2003 to 9/15/2003 and the Philippines’ EB3 priority date also moved up 15 days from 4/15/2007 to 5/1/2007.
• For EB5, priority dates remain current.

• In the family sponsored F2A category, the priority date has not changed except for Mexico. The priority date for China-mainland born remains at 9/8/13. For Mexico, the priority date in this category retrogressed from 9/1/2013 to 4/15/2012.

For China-mainland born, EB3 priority date (9/1/2012) continues to be more recent than EB2 priority date (2/15/2009). Therefore, if you already have an approved EB2, you may be eligible to port your priority date to the EB3 category to obtain your green card faster without going through the PERM process again.
